TOS
Definitions:
Phytec-Hosting ("we", "us", "our") applies the following terms and conditions to all customers ("you", "the customer", "the customers") who use the products/services provided by us: are offered ("the Service", "the Services") purchase or use.
Damage:
We are not liable for damage or loss of data that is not caused by us or is not our responsibility.
Force of the majority
If we are unable to provide the services (on time) due to force majeure, we are not liable for any damage.
Force majeure includes all things that we could not take into account in advance in any circumstances.
This includes illness, war or danger, fire, strikes, terrorism, sabotage, earthquakes, power outages, flooding and other disturbances in or around the companies/suppliers on which the service depends.
In the cases mentioned, we are not obliged to provide the services and we may postpone this until the problems have been fully resolved.
Downtime
We do not have to pay compensation to the customer for any downtime or (un)expected maintenance.
We are not liable for errors that may occur during or after maintenance.
We will, however, resolve the errors as soon as they appear or are reported.
Backups
The customer is responsible for making backups of his service.
Amendments to the General Terms and Conditions
We have the right to change the general terms and conditions at any time.
The changes will take effect seven days after the customer is notified.
Illegal Activities
It is not allowed to use the service for illegal activities.
By illegal activities we mean everything that is illegal according to Dutch law, such as DDOS, hacking, attacks, etc.
If the customer nevertheless uses the service for illegal activities, we may close the service immediately.
cancellation
The customer can cancel the service at any time.
The customer can get a refund as soon as the customer cancels the service within 24 hours of starting the service.
In case of cancellation after 3 days, we do not owe the customer any compensation.
In the event of cancellation, we are not liable for any damage or loss of data.
suspension
We have the right to discontinue the customer's service if no payment has been made before the payment period.
